High Court Observes Haryana Tax Tribunal Chairman, Members Appointments Invalid

Chandigarh (I-Haryana News): The political motivated appointments hit Haryana on Thursday suffered further when the Punjab and Haryana high court observed that selection and appointment of chairman and three members of Haryana tax Tribunal, made in 2011 by Hooda government, were not in accordance with law set by the Supreme Court of India.

As per information, the Punjab and Haryana High Court division bench, comprising Chief Justice A K Sikri and Justice Rakesh Kumar Jain expressed above mentioned observations while hearing a Public Interest Litigation filed by Panchkula resident Vikas Miglani, and asked Haryana government to start fresh process for appointments as per apex court guidelines within one week.

The matter has been adjourned for February 8 for further hearing.

It is to mention that Haryana Government headed by Chief Minister, Mr. Bhupinder Singh Hooda decided to appoint Justice S L Bhayana of Jessica Lal Murder case famed judge as Haryana Tax Tribunal chief and two others as members in Ma 2011, but within few days of this development Hooda reversed his decision and appointed of K S Bhoria, IAS (retd) as chairman in place of Justice S L Bhayana without consulting the Punjab and Haryana High Court, which was mandatory as per supreme court guide lines.

Further, Petitioner said that Yudhavir Singh, a close relative of Haryana advocate general, Hawa Singh Hooda, was appointed for second term as member of the tribunal, even violating the Act.
